Formicary Corrosion Responsibility
HVAC systems often utilize copper coils. In some cases, when exposed to certain organic substances, the copper coils and other copper components may fail due to formicary corrosion. If formicary corrosion occurs, complete replacement of the system may be necessary. Suncoast Air Conditioning LLC (the “Seller”) does not warrant, guarantee, or assume any liability or responsibility for formicary corrosion or for the repair or replacement of any equipment that fails as a result of formicary corrosion. It is the responsibility of the purchaser to ensure that they have adequate protection or insurance against such events or conditions.
The Seller excludes all liability or responsibility for formicary corrosion, including any costs related to investigation, repair, or replacement of equipment, and any incidental, special, or consequential damages arising from equipment failure due to formicary corrosion. This exclusion applies regardless of the cause of the formicary corrosion. The purchaser assumes all risks associated with formicary corrosion and agrees to hold the Seller harmless from any and all claims, demands, and legal actions, both at law and in equity, for any damages—including direct, indirect, consequential, special, and incidental damages—that may arise from or relate to formicary corrosion of any part of the equipment or goods provided by the Seller.
This exclusion supersedes all other terms, conditions, guarantees, or warranty language that may exist between the Seller and any other party.
